Overstay in Malaysia: Latest Updates for Foreign Nationals

Malaya Corporate recently attended an OSC MM2H Engagement Session with MM2H Programme Operating Companies organised by MOTAC.
 
One of the latest updates shared during the session is regarding overstay in Malaysia.
Important Update on Malaysia Overstay
 
If a foreign national overstays in Malaysia and the case is eligible under the Programme for the Management of Overstays in the Control Sector (PTSK), the foreign national must attend the Immigration counter personally.
 
This is important to note because the process cannot simply be handled by an agent on behalf of the individual.
The foreign national will need to bring:
  • Original passport
  • Travel ticket within 7 days
The Immigration officer will then verify the case and determine the applicable compound. The compound must be paid in full on the same day.
Malaysia Overstay Compound
 
For eligible cases, the compound rates are:
1–30 days: RM30 per day
31–60 days: RM1,000
61–90 days: RM2,000
 
PTSK is not only for MM2H holders. It covers eligible foreign nationals holding certain types of passes, subject to the applicable requirements.
Cases involving an overstay of more than 90 days and certain other circumstances may not be eligible for PTSK.

Our Advice

 
If you are a foreign national staying in Malaysia, always check your pass expiry date early.
Do not wait until your pass has expired before taking action on your renewal or extension.

The latest PTSK procedure is something foreign nationals, employers and agents should be aware of when dealing with an overstay in Malaysia.
