DIRECT SELLINGS\nBUSINESS<\/o:p><\/span><\/b><\/p>

Direct Sales refer to door-to-door sales, mail\norder sales or sales through electronic transactions. The Ministry of Domestic\nTrade and Consumer Affairs is the body responsible for the management of direct\nselling business. The Direct Selling Business is guided by the Direct Sales and\nAnti-Pyramid Scheme Act 1993 and the Direct Selling Regulations.<\/o:p><\/span><\/p>

 <\/span><\/p>

TYPES OF DIRECT SALES BUSINESS MARKETING<\/o:p><\/span><\/u><\/b><\/p>

There are three types of marketing plans under\na direct selling business, namely:<\/o:p><\/span><\/p>

1.    <\/span><\/span><\/b>Multi-Level Marketing Plan<\/o:p><\/span><\/b><\/p>

\u2022     \n<\/span><\/span>The\ncompany will recruit\/appoint individuals as members\/distributors to distribute\nthe company’s products.<\/o:p><\/span><\/p>

\u2022     \n<\/span><\/span>The\nmember\/distributor concerned will appoint another individual (downline) to form\na network selling the company’s products. The process of recruiting new\nmembers\/distributors can be continued up to a reasonable level.<\/o:p><\/span><\/p>

\u2022     \n<\/span><\/span>Each\nmember\/distributor will get a commission\/bonus\/incentive from personal sales\nand sales of members\/distributors under his network (overriding bonus).<\/o:p><\/span><\/p>

2.    <\/span><\/span><\/b>Single Level Marketing Plan<\/o:p><\/span><\/b><\/p>

\u2022     \n<\/span><\/span>The\ncompany will appoint a sales representative\/sales agent and pay salary \/commission\/combination\nof salary and commission on the total sales made; and<\/o:p><\/span><\/p>

\u2022     \n<\/span><\/span>The\nsales representative\/sales agents are not allowed to appoint\/sponsor other\nsales representatives \/sales agents<\/o:p><\/span><\/p>

 <\/span><\/p>

3.    <\/span><\/span><\/b>Sales Through Mail Order (Mail\nOrder)<\/o:p><\/span><\/b><\/p>

The sale of goods or services\ncarried out by a person, either personally or through any authorized person by\npost or any other method of delivery including electronically.<\/o:p><\/span><\/p>

CONDITIONS OF ESTABLISHING A DIRECT SALES\nBUSINESS<\/o:p><\/span><\/u><\/b><\/p>

i)      <\/span><\/span>The applicant must be a company\nincorporated under the Companies Act 1965\/2016<\/o:p><\/span><\/p>

ii)    <\/span><\/span>Have paid -up capital by marketing\ncategory:<\/o:p><\/span><\/p>

APPLICATION FOR NEW LICENSE AND RENEWAL<\/o:p><\/span><\/u><\/b><\/p>

For NEW and RENEWAL applications for Direct\nSelling License, please refer to the <\/span>KPDNHEP website<\/span><\/a><\/span> for a checklist of required\ndocuments.<\/o:p><\/span><\/p>

1.    <\/span><\/span>Application documents must be in the\norder as in the checklist.<\/o:p><\/span><\/p>

2.    <\/span><\/span>All relevant documents must be\ncertified by the Company Secretary.<\/o:p><\/span><\/p>

3.    <\/span><\/span>The company must submit the\napplication through BLESS 2.0 and a copy of the application must be sent to the\ncounter of the Franchise Development and Direct Sales Division of KPDNHEP\neither by hand delivery or post.<\/o:p><\/span><\/p>

4.    <\/span><\/span>The company’s application will be\nprocessed after the Ministry receives the complete documents. Only complete\napplications will be processed for consideration.<\/o:p><\/span><\/p>

DIRECT SALES LICENSE TERMS<\/o:p><\/span><\/u><\/b><\/p>

The list of conditions that must be met by the\nlicensee can refer to the <\/span>Application Procedure<\/span><\/a><\/span> document on the KPDNHEP website.<\/o:p><\/span><\/p>

 <\/span><\/p>

PAYMENT RATE<\/o:p><\/span><\/u><\/b><\/p>

The fee for the license is RM500 per year and\nmust be made in the form of Bank Draft or Money Order and in the name of the\nSecretary General of the Ministry of Domestic Trade, Cooperatives and\nConsumerism.<\/o:p><\/span><\/p>

\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nObtaining a license must be done personally by\nthe Managing Director or Top Management of the Company and make a certificate\nof acceptance of the license conditions at the office of the Domestic Trade\nDivision, Ministry of Domestic Trade, Cooperatives and Consumerism<\/span>
